Terms and Conditions for Carlow Kildare School of Motoring

These Terms and Conditions ("Terms") govern the use of the services provided by Carlow Kildare School of Motoring ("the School," "we," "our," or "us"). By engaging with our services, including but not limited to driving lessons, driving courses, and other related activities, you ("the Student," "you," or "your") agree to abide by the following Terms.

1. Driving Lessons

1.1 Booking & Payment:

  • All driving lessons must be booked in advance.
  • Payments for lessons can be made either in advance or on the day of the lesson when you meet the instructor.
  • Payments for block bookings (multiple lessons) may be required upfront.

1.2 Cancellation and Rescheduling:

  • A minimum of 24 hours' notice is required for cancellation or rescheduling of a driving lesson.
  • Cancellations made with less than 24 hours' notice will incur a cancellation fee of the full price of the lesson.

1.3 Late Arrivals:

  • If you are late for a lesson, the lesson time will not be extended, and you will still be charged for the full lesson.
  • If the instructor arrives late, the lesson time will be extended to accommodate the lost time, provided that it does not interfere with subsequent bookings.

2. Driving Instructor

2.1 Instructor Conduct:

  • The instructor will provide professional and courteous service and ensure that all lessons are conducted in a safe and respectful manner.

3. Vehicles and Equipment

3.1 Use of Vehicle:

  • Students are required to use the vehicle provided by the School for all lessons unless specifically agreed otherwise.
  • The School's vehicles are maintained to meet all legal and safety standards.

4. Conduct During Lessons

4.1 Student Responsibility:

  • The student must ensure that they have a valid provisional or full driver’s license for the lesson.
  • You must be in a fit state to drive and not under the influence of alcohol, drugs, or any other substances that impair driving ability.
  • If the instructor believes you are unfit to drive for any reason, the lesson may be cancelled, and no refund will be given.

4.2 Safety:

  • Students must wear seat belts at all times while driving.
  • All students must comply with the traffic laws and follow the instructor's directions during lessons.
  • Instructors may end a lesson early if they believe the student’s safety is at risk or if the student is not following instructions.

5. Driving Tests and Preparation

5.1 Test Booking:

  • The School does not guarantee success in the driving test but will provide the necessary training and preparation.
  • If a student is unsuccessful in their driving test, they may book additional lessons with the School to further prepare.

5.2 Driving Test Fees:

  • Fees for the driving test itself are not included in the lesson costs and must be paid separately to the appropriate authorities.

6. Refunds and Cancellations

6.1 Refunds:

  • Refunds will be provided in cases where the School cannot deliver a service due to reasons within the School's control.
  • Refunds are not provided for lessons missed by the student, unless the School cancels the lesson.
  • Vouchers for lessons cannot be returned or refunded.

6.2 Cancellation Fees:

  • Cancellations with less than 24 hours' notice will incur a cancellation fee of the full price of the lesson.

6.3 Termination:

  • The School reserves the right to terminate a student’s lessons if they repeatedly fail to meet the Terms and Conditions or demonstrate unsafe driving behavior.

7. Data Protection

7.1 Personal Data:

  • The School collects personal information from students to provide our services, which is processed in accordance with the General Data Protection Regulation (GDPR).
  • By booking lessons, students consent to the collection and use of their data for the purpose of providing driving instruction and related services.

8. Liability

8.1 Limitations of Liability:

  • The School is not liable for any personal injury or loss of property during lessons, except where such injury or loss is directly caused by negligence on the part of the School or its instructor.
  • The School shall not be responsible for any delays or inconvenience caused by factors beyond its control, such as weather conditions or vehicle breakdowns.

9. Governing Law and Dispute Resolution

9.1 Jurisdiction:

  • These Terms and Conditions shall be governed by and construed in accordance with Irish law.
  • Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

10. Changes to Terms and Conditions

10.1 Amendments:

  • The School reserves the right to change or amend these Terms and Conditions at any time, and any changes will be communicated to students in writing or via email.
